The person will get lynched. Lynches always win over no lynches in a tie.
Also, regarding winning if dead, there's no set rule. It's a personal thing. If you want to count games where you die as losses, go right ahead, but no-one is wrong for not doing so.
So, Human - care to explain why you voted Neonsands? And I'm not accepting "random vote", because you willingly voted knowing you would cause a majority in the current votes. I'm not saying lynching the tracker is scummy, just that you told us AFTER Neon was lynched that you had the doublevote power (that's basically what it is).

I've always hated Chumley when GX was on the air but now is the time where we could've really used him.
From the looks of it, the Neon vote was seemingly random though.

Night had finally arrived. It was no longer quiet at Duel Academy, not after Hayato’s murder… it had to be the work of the intruders.
Judai, who was still distraught over the fact that his friend was dead, wandered off. He didn’t listen to Sho, telling him not to leave the dorm at night… he wasn’t about to listen to anyone. The brunette honestly thought that leaving for a while would help him gain clues.
The small boy, Sho, was getting worried… Judai had been out for a while. “I can’t wait anymore, I need to go look for Aniki—“
“Just a sec! Sho, let me come with you-don!” A Ra Yellow student, Tyranno Kenzan was spending the night at the Osiris Red Dorm.
After nodding, the two left the dorm and entered the dark woods. “I-it’s scary here…” Sho said with a slight whimper.
“Be a soldier-saurus! This is for Judai!”
The braver of the two… he could be a threat. Strong and intelligent, such a person could not exist on this island.
Stealthily walking, neither tried to make much noise. Both hated to admit it, but they weren’t having much luck…
“Let’s split up. I’ll go this way, you go that way-don.”
“WHAT!? B-but, I mean… what if something happens to one of us?!”
“Better it happen to one than both. I’ll be off.”
With that, Kenzan waved to Sho and went on his way, searching for Judai. Suddenly, rustling was heard coming from somewhere in the darkness of the forest. Looking around, Kezan shouted out, “Who’s there-don?! Judai---“
As soon as he said, a sudden excruciating pain was being felt… Kenzan was stabbed right in the back, causing him to fall to the ground. What happened..!?
“This is nothing personal.” A tall man with hair that resembled a dagger spoke… as he proceeded to stab him one last time, leaving Kenzan dead.
Meanwhile, with Sho… “Aniki! Is that you?! There you are! Come on, let’s go get Kenzan and go…”
“Sorry, Sho. I was just… that was stupid of me.” Judai laughed. After leaving though, Judai seemed a tad different… but that was the least of their issues now. Judai turned his head over to see a shadowy figure walk by. Running towards it, he looked down to see Kenzan, on the ground… murdered.
In a separate part of Duel Academy, Ryo Marufuji was just standing at the port, like he used to before he left the school… recalling old memories.
Before when he was a legend.
When he was respected.
When he wasn’t a ‘loser’.
Those days were gone. They would never come back, no matter how much he wished it… Staring at the ocean with a look of nostalgia, he saw someone’s reflection behind him.
He could have sworn he saw his younger brother’s reflection in the water, causing him to look back. “Was it... my imagination?”
After getting engaged in ‘underground duels’, Ryo’s health was worsening. With that in mind, he wouldn’t have been surprised if he had just imagined Sho’s face in the water.
At that moment though, the fact that intruders were on the island… the reality hit him. They could kill him. They could kill Sho. They could kill anyone he cared about… Feeling a sudden surge of panic, he decided to go see Fubuki Tenjoin and tell him to keep a close eye on Sho and his friends. After all, he could never do that himself.
Oddly enough, the security in the dorm was lax enough that he could just walk inside and make his way right to his friend’s dorm.
Well that isn’t safe.
Knocking for about two minutes, no one answered. Was he not inside? And just as he was about to call his name, some security guards came running in, surrounding Ryo.
“…What’s this about?” He curiously asked, seeing that the guards were armed.
“Some kid came and told us that the intruder was seen around here. We’ve never seen you at the school before… it’s you, isn’t it?!”
“Heh. Is that what you think? I’ve been here before… this is where I used to live.”
Staring at the armed men, Ryo could sense something odd about them… their eyes looked glazed over. They looked as if they were being manipulated. As he took his guard off for that one moment, the men aimed their weapons right at him.
“Don’t… this is where I used to live! I was like the king of this place, you don’t---“ Ryo tried to plea, but it was no matter…
He was shot, assumingly dead. The men left his body there, and he layed… he recalled what the men said.
Some kid came and told us that the intruder was seen around here.
No kids are at the school. The only one who looked like a kid was… Sho.
His last words, thinking about his brother… drifting into a sleep he would never awaken from. The ‘king’ had fallen.
