But they use types such as Grass, Fire, and Water.
So? By that logic, any game that uses things like Water or Fire for monster types would be infringing on Pokémon.
Can you think any RPG that uses elemental types on their monsters (Besides Yu-Gi-Oh, which is a children's card game)?
Not offhand, but you're talking to someone who doesn't play many RPGs.
The logic to this is that the people who made this looked at Pokemon for ideas or perhaps they wanted to put Pokemon on a cell phone like devise but failed miserable and the people who made this will get sue'd badly for doing a horrible job of discising it as something different from Pokemon

As long as they don't actually infringe on something in the Pokémon series, I don't think they could be sued. Well, they could, but I doubt the case would stand. :/
This thing is as I keep on looking at the pictures from this game,the mon's in that game look very closely to Pokemon them self...This game don't even qualify for Fair Use too...
Even it you make something that looks like Pikachu,you based your creation off of a licensed product 'hence Copyright Infringement
If its just a water monster or something no they cant, I think it would have to be very similar for them to be able to do anything.

Eh, well whatever. If they're truly infringing, they'll be punished for it sooner or later.
When it come to type of stuff,Nintendo and The Pokemon Company lose there straight jackets when it comes to sue'ing people.
I cant post the parts that are infringing right now due to the stupid forum thingy but the only way they can get out of it is if they asked The Pokemon Company if they could make a game based off of the Pokemon franchise...I dont see the part that Zynga Inc. asked The Pokemon Company so I expect to see a legal war starting.
Don't get me started on Final Combat, which a rip-off of TF2.
