I've never personally used either, but I like Banette's design and motif a fair bit better.
Mismagius, as stated by others, has a better movepool and better stats.
In response to your Sucker Punch argument, consider this scenario:
Banette uses Sucker Punch, but it fails because Mismagius uses Substitute instead of an damaging attack. Mismagius now protected by a Substitue and is free to either KO Banette with Shadow Ball or Calm Mind/Nasty Plot up. Where's your Sucker Punch now?

With Banette's immense attack power, if mismagius gets hit at all its done for.
I've always had a soft spot for Banette, so his getting my vote.

Mismagius. I like it's design slightly better, it has better stats, and it's cry creeps me out.
Bannete is all around cooler.

Better design: While its evolution is strange, I choose Banette. Shuppet is the most original ghost type there is and Banette is like a pokemon version of Chucky.
Most Useful: Banette. No idea why; they both learn a great variety of good attacks, both are pretty powerful. However, with Mismagius evolving through the use of a Dusk stone, Banette pushes slightly ahead.
Best battler: Well, Banette is a good attacker and Mismagius falls on the defensive side.
And I really cant be bothered to carry on so my choice is Banette.

Bannete. While it doesn't have that good of a movepool, I still really like its concept and design, as well as some of the moves it has. Plus, Mismagius kind of scarews me... o_0

Mismagius is awesome. It can be used with a Nasty Plot set with Shaodw Ball, Thunderbolt/HP Fighting and Substitute and has a larger movepool. It can also use a defensive set with Will-O-Wisp, Taunt and Pain Split, really good on Stall teams for spinblocking.
Banette is good for Trick Room teams...It's ugly anyways. Ugh. D:
