Actually, I believe the law on them is you can download them if you have the game in real life, as you've already paid for the game previously. However if in real life you don't own the game, then thats where it becomes illegal.

The law on ROM's is very vague.

Honestly, I doubt it's like that. I find it that like saying stealing something from a store is legal because you already owned the product...

That's another common misconception. Technically, they have no legal ground to drop the scythe if we're simply discussing them, otherwise, all the emulation and ROM hacking boards would've gotten shut down a long time ago. Promoting them is similarly all right. Linking is slightly more iffy, but generally speaking, it's okay. Now hosting, that's a whole other story. That'll get the scythe - not from Nintendo though, but rather, from the host.

Of course, the corrupt morally people would throw a hissy fit, so I suppose the rule stays regardless.

*10 points of infractions equals a 2 day ban. 20 points is a 10 day ban, 30 points a 1 month ban, 40 points a 3 month ban, 50 points = infinite.
