That's another common misconception. Technically, they have no legal ground to drop the scythe if we're simply discussing them, otherwise, all the emulation and ROM hacking boards would've gotten shut down a long time ago. Promoting them is similarly all right. Linking is slightly more iffy, but generally speaking, it's okay. Now hosting, that's a whole other story. That'll get the scythe - not from Nintendo though, but rather, from the host.
Of course, the corrupt morally people would throw a hissy fit, so I suppose the rule stays regardless.
