So I know some of you are from Texas. I've seen you say so yourself! And this is an important matter you might want to read about! So I'm sure as you know, in 2005, Texas banned gay marriage. Okay. But! Due to a wording error, they technically banned all marriage.
It's official law, too. It says, "The constitutional amendment providing that marriage in this state consists only of the union of one man and one woman and prohibiting this state or a political subdivision of this state from creating or recognizing any legal status identical or similar to marriage." So in summary, there are two clauses about marriage.
Two's the key here. Alone, it would stand - it bans all marriage. But together, it doesn't directly reference the first clause, it clearly states that Texas does not recognize marriage (because marriage is identical to marriage).1. Marriage in this state consists only of the union of one man and one woman.
2. Prohibiting this state or a political subdivision of this state from creating or recognizing any legal status identical or similar to marriage.
Now, this probably won't lead to all marriages from 2005 on being invalidated, but it does open a whole lot of legal ramifications related to marriage-related issues. Law practically revolves around wording errors like this! People will be able escape from things using this pretty severe legal loophole! Precedent could take over if one goes through, leading to the unthinkable! All because of one massively stupid mistake! So indeed! Texas does not discriminate as commonly believed with strong evidence supporting to boot! So don't feel bad gays! Straight marriage is banned too!
